Terms of Service — Medessens

These Terms of Service ("Terms") govern your access to and use of medessens.in (the "Site"), operated by Medessens ("we," "our," "us"), which sells equipment, instruments, and apparel (including scrubs and aprons) for healthcare students across medical, dental, nursing, and allied health fields. These Terms are framed in accordance with the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or accessing the Site under the supervision of a parent/guardian or institution, to place an order. By using the Site, you confirm that the information you provide is accurate and that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

2. Nature of Products

Medessens sells equipment, instruments, and apparel for healthcare students across medical, dental, nursing, and allied health fields. Our catalogue includes two distinct categories:

Training and instructional equipment (e.g., suture practice pads, anatomical models, dissection kits): these products are intended for educational and training use only. They are not hospital-grade medical devices, diagnostic equipment, or items intended for use on or in connection with actual patients, and are not a substitute for supervised clinical training or instruction from a qualified institution.
Apparel (e.g., scrubs, lab coats, aprons): these are wearable garments and may be worn in clinical, hospital, or academic settings as ordinary professional attire. The above clinical-use restriction does not apply to apparel.

You are responsible for ensuring that any product you purchase is used appropriately, safely, and in line with your institution's guidelines.

3. Account Registration

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@medessens.in if you suspect unauthorized use of your account.

4. Orders and Pricing

All prices on the Site are listed in Indian Rupees (INR) and are inclusive/exclusive of applicable taxes as indicated at checkout.
We reserve the right to refuse, cancel, or limit the quantity of any order, including in cases of suspected fraud, pricing errors, or stock unavailability. Where we cancel a confirmed order, any payment already made will be refunded.
Product images are for representation purposes; minor variations in colour, packaging, or finish may occur.

5. Payment

Payments are processed through PayU, our third-party payment gateway partner. We do not store your full card, UPI, or net-banking credentials on our servers. By making a payment, you agree to PayU's applicable terms and security protocols in addition to these Terms.

6. Shipping and Delivery

We aim to ship and deliver orders within the timeframe indicated at checkout or in your order confirmation; timelines are estimates and not guaranteed.
Risk in the goods passes to you upon delivery to the shipping address provided at checkout. Please ensure your address and contact details are accurate.
Delays due to courier, customs (where applicable), or circumstances beyond our reasonable control are not our liability, though we will assist in tracking and resolving delivery issues.

7. Cancellation, Returns, and Refunds

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:

Cancellation: You may cancel an order free of charge within 3 hours of placing the order by contacting support@medessens.in. Cancellation requests after this window cannot be guaranteed, as the order may already be processed for shipping.
Returns: We offer free returns within 3 days of delivery, provided the product is unused and in new condition, in original packaging, and accompanied by proof of purchase, except where noted below.
Non-returnable items: For hygiene and safety reasons, used consumables (e.g., suture pads once used, opened dissection kit components) and apparel that has been worn, washed, or altered are not eligible for return unless defective or incorrectly shipped. Customized apparel (e.g., items with name, logo, or size customization) is not eligible for return or cancellation once the customization has been applied.
Refunds: Approved refunds will be processed to the original payment method within one week after we receive the returned item and it passes inspection.
Defective or incorrect items: If you receive a defective, damaged, or incorrect product, contact us within 48 hours of delivery with photographic evidence so we can arrange a replacement, repair, or refund.

8. Intellectual Property

All content on the Site — including the Medessens name, logo, product descriptions, images, and design — is owned by or licensed to Medessens and is protected under Indian copyright and trademark law. You may not reproduce, distribute, or use this content commercially without our prior written consent.

9. User Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to the Site, other accounts, or our systems
Post or transmit any harmful, fraudulent, or misleading content in reviews, inquiries, or communications
Interfere with the security or proper functioning of the Site

10. Limitation of Liability

To the extent permitted under applicable Indian law, Medessens shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or products, including loss arising from misuse of training equipment outside its intended educational purpose. Nothing in these Terms limits any liability that cannot be excluded under the Consumer Protection Act, 2019.

11. Indemnity

You agree to indemnify and hold Medessens harmless from any claims, damages, or expenses arising from your misuse of the Site, violation of these Terms, or misuse of any product outside its intended educational purpose.

12. Grievance Redressal

In accordance with the Information Technology Act, 2000, the Consumer Protection Act, 2019, and rules made thereunder, the Grievance Officer for Medessens is:

We will acknowledge grievances within 48 hours and aim to resolve them within 30 days of receipt. You may also approach the National Consumer Helpline (1915) or the appropriate Consumer Disputes Redressal Commission for unresolved disputes.

13. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our practices, products, or legal requirements. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hingoli, Maharashtra, without prejudice to any statutory consumer forum rights you may have under the Consumer Protection Act, 2019.
